The information provided below intends to provide you all relevant information about how Kimzio Digital, LLC (hereinafter, “we”, “us”, “our” or “Kimzio”) collect and process your data, which may be collected through by this website kimzio.com, (hereinafter, “website”). 

This Privacy Policy of Kimzio describes the privacy and data security principles followed by Kimzio regarding the personal information of individuals who visit our website, as well as the personal information of our customers (“individuals”). Personal information includes any data by which an individual can be identified or located (for instance, a person’s name, address, phone number or email address). 

This Privacy Policy will help you understand how we collect and use the personal information you share with us, and it describes your choices regarding use, access, correction and deletion of any personal information you share with us. By using or accessing the Kimzio website, you are accepting the practices described in this Privacy Policy.

This Privacy Policy also describes how Kimzio handles customer information and services data (defined below) to which Kimzio may have access as we perform services on behalf of our customers. Which data we collect

Customer Information is information that we may collect from your use of the Kimzio websites and your interactions with us off-line. Kimzio collects contact information so that we can create and manage customer accounts. For instance, Kimzii collects personal information about representatives and contacts at its customer organizations, including their contact information (name, address, telephone numbers, and email addresses), job title, and name of employer. We also collect similar contact information about representatives of our vendors and business partners. 

We also receive personal information that you provide at in-person meetings, by email, Chat, social media messages, or other communications, or by posts or other interactions with its social media accounts. Our website also includes forms by which you can submit your name and email address to be included in our email list to receive our newsletter. 

Kimzio may keep track of the websites and pages our users visit within Kimzio for the operation of the website, to maintain quality and to provide general statistics regarding use of the Kimzio website.

Services Data is data that resides on our systems, or on our customers’ or third-party systems to which Kimzio is provided access to perform services (including test, development and production environments that may be accessed by Kimzio to perform consulting and support services). Kimzio treats services data in accordance with the terms of this Privacy Policy, except where the terms of a service contract with a customer define different requirements.

To illustrate the difference between customer information and services data, when a customer contracts with Kimzio for its services, the customer provides information about itself, including its name, business and email addresses, billing information, and some employee contact information. When a customer uses a Kimzio website to contact us or learn about our products or services, our website also collects information about the customer. All such information is customer information and is treated according to this Privacy Policy.

In contrast, when a customer contracts with Kimzio to perform services, that customer may provide Kimzio with access to its production, development or test environment, which may include personal information about its employees, customers, partners or suppliers. All such information is services data.

How we collect your personal data

Depending on how you use our website and our services, we may collect the following types of information and use it in this manner:

Information you provide – We offer access to some information and services without a charge, but for you to learn more about our products, services and support we ask that you complete a registration form. In this instance, we ask you to provide the following personal information:

  • First and last name;
  • Company and title;
  • Email address; and
  • Phone number.

Accessing our website – Log Files – Like most websites, our site automatically collects and uses the data contained in log files. Information in log files may include your computer’s IP (internet protocol) address, your ISP (internet service provider), the web browser you used to visit our site, the time you visited our site, which web pages you visited, and other anonymous site usage data. Every computer with internet capability is given a number that serves as that computer’s IP address. When you request a page from any site within the Kimzio network of websites, our web servers automatically recognize your IP address. The domain name and IP address reveal nothing personal about you other than the IP address from which you have accessed our websites. We use this information to examine traffic in aggregate, investigate misuse of Kimzio website, detect fraud, and cooperate with law enforcement.

How we use the information collected

We collect and use your personal information to provide our products and services, as well as products and services of our suppliers and partners, to you and to operate and improve our website and services. In order to access some parts of our websites and/or for you to request specific information or services, we may need to collect personal data from you which we will process for the purposes described hereunder.

As part of pre-contractual and/or contractual obligations, we may process your personal data for:

  • answering any requests, queries or inquiries you may submit on our website;

  • maintaining and improving the website as well as to ensuring its security;

Kimzio may process services data but Kimzio does not control your information collection or use practices for services data. To communicate with you – We communicate with you through email and notices posted on our website, including (1) welcome and engagement messages following your registration on a Kimzio website; (2) service messages addressing service availability, security, and other issues about the functioning of Kimzio’s products and services; and (3) promotional emails, which may contain promotional information about Kimzio or about our business partners. 

Other Uses – Kimzio may transfer and access services data globally. If Kimzio hires subcontractors to assist in providing services, their access to services data will be consistent with the terms of this Privacy Policy, except where the terms of your service contract define different requirements.

These purposes are justified by our legitimate interest to make sure that you enjoy the experience when visiting our website and interacting with us. 

Who has access to your personal data

Your personal data is accessible to Kimzio and is restricted to the authorized personnel within Kimzio; including duly authorized contractors, partners and service providers. Kimzio may share data with trusted partners or contractors to help perform statistical analysis, send you email, provide customer support, or to perform the service. All such third parties are prohibited from using your personal information except to provide these services to Kimzio, in accordance with this privacy policy.

When providing products and services to our customers, we may facilitate storage, maintenance, and transmission of our customers data, including personal information, using products and services from our partners and suppliers. The agreements between our customers and our partners require that the service providers maintain the confidentiality of customer data, use customer data only for purposes of delivering their services to customers, and adhere to applicable data protection laws.

We may share or transfer personal information about you in connection with a merger, acquisition, reorganization, or sale of assets of our business, in the event of bankruptcy, or during the negotiations leading to such an event. We will seek assurances from any buyer that your personal information will be used, shared, maintained, and disclosed consistent with the terms of this privacy policy.

We may also be required – by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence— to disclose your personal data.  We may also disclose your personal data if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.

Except as listed above, we will not sell, distribute, transfer, or lease your personal information to third parties.

Data retention –  Your personal data are kept and processed by us for a period of time that is necessary based on the goals of the processing, and/or based on the contractual relationship between Kimzio and you. As a matter of principle, it is kept for the duration of the business relationship that is established between you or your company and Kimzio. In any case, your data will be kept in accordance with the specific records management and retention policies and procedures we follow, in line with the recommendations of the competent data protection authorities.

Security of Your Information – We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. We restrict access to personal information to our employees, contractors, agents and authorized third parties who need to know the information to operate, develop or improve our services. These individuals are bound by confidentiality obligations. When these individuals “need to know” expires, their access to your personal information is thereafter prohibited.
